Helping Your Family Get the Compensation It Needs
According to the Centers for Disease Control and Prevention (CDC), the lifetime cost of caring for a baby with cerebral palsy can reach nearly $1 million. That estimate does not include the loss of income and benefits of family members who must become caregivers, or other out-of-pocket costs. In some cases, the amount may be more than $1 million. In our experience, the amount can exceed $10 million. If you have a baby who suffered cerebral palsy or another birth injury, your family will need compensation.
Walker, Hamilton & Koenig, LLP may be able to help. Attorney Timothy M. Hamilton has 31 years of experience with malpractice claims. He was formerly a defense attorney representing doctors and hospitals in medical malpractice cases. He uses this experience today as he represents injured infants and their families. Cerebral Palsy and Additional Birth Injuries
Cerebral palsy and other birth injuries can be caused by medical malpractice before, during or after the birthing process. Cerebral palsy is a type of hypoxic-anoxic encephalopathy (partial oxygen deprivation) injury to the brain. It can result in developmental disabilities such as impaired motor skill function, speech problems, learning disability, cognitive disability and emotional difficulties.
Other common birth injuries include:
- Intraventricular hemorrhage
- Erb's palsy
- Brachial plexus
- Shoulder dystocia
- Broken clavicle
These injuries can be caused by issues such as oxygen deficiency, the umbilical cord wrapping around the baby's neck, too much time in the birth canal, improper use of a vacuum or forceps, the baby's shoulder getting caught on the mother's pubic bone during birth, failure to perform a C-section or failure to consult a maternal-fetal medicine specialist for complex births and high-risk pregnancies.
Working with quality medical experts, as well as life-care planners and economists, we will calculate your past and future expenses for a birth injury. We aggressively pursue birth injury claims and will be prepared to go to trial when that is your best option.
